Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Webcap’s website, dashboard, and Screenshot API (collectively, the “Service”). By creating an account, integrating the API, or otherwise using the Service, you agree to these Terms.
1. Eligibility & Account
- You must be at least 16 years old and capable of forming a binding contract.
- You are responsible for all activity under your account and for safeguarding API keys and credentials.
- Provide accurate registration information and keep it up to date.
2. License & Acceptable Use
Subject to these Terms, Webcap grants you a limited, non-exclusive, non-transferable license to access and use the Service. You agree not to:
- Misuse or overload the Service, bypass rate limits, or attempt to access our systems without authorization.
- Use the Service to violate any law, third-party rights (including IP, privacy, or publicity), robots.txt policies, or site terms of the captured pages.
- Transmit malware, attempt to decompile or reverse engineer the Service, or resell the API without our consent.
3. Content & Screenshots
- You are solely responsible for the URLs and content you capture. Ensure you have rights to process and store such content.
- Unless otherwise specified, screenshots and transient artifacts may be stored temporarily (typically under 24 hours) for delivery, retries, and diagnostics.
- We may remove content or suspend jobs we reasonably determine to be unlawful, harmful, or in breach of these Terms.
4. Rate Limits & Fair Use
Rate limits and quotas depend on your plan and are enforced per minute. We may throttle, queue, or reject requests that exceed limits or materially degrade the Service for others.
5. Plans, Billing & Taxes
- Paid subscriptions renew automatically each billing cycle until canceled. PAYG usage is billed per successful request.
- Overage beyond included credits is billed at the posted overage rate. Prices may change with prior notice for future cycles.
- Fees are non-refundable except where required by law. You’re responsible for applicable taxes.
6. Cancellation & Termination
- You may cancel at any time from the dashboard; cancellation takes effect at the end of your current billing period (unless stated otherwise).
- We may suspend or terminate access for violations of these Terms, legal requirements, or to protect the Service, users, or third parties.
- Upon termination, your license ends and your access to screenshots or logs may be discontinued.
7. Service Availability & SLA
We aim for high availability and reliability, with queueing and retries. Where applicable, SLA terms are described on the plan page or a separate agreement. Scheduled or emergency maintenance may affect availability.
8. Security
We implement industry-standard security controls. You are responsible for securing your systems, API keys, and content. Notify us promptly of any suspected compromise at hello@getwebcap.com.
9. Intellectual Property
Webcap, including its software, APIs, documentation, and trademarks, is owned by Webcap Inc. Except for the license expressly granted, no rights are transferred. You may submit feedback; we may use it without restriction.
10. Third-Party Services
The Service may rely on third-party providers (e.g., hosting, payments). Their services are subject to their respective terms and policies.
11. Beta & Experimental Features
We may offer preview or beta features that are optional, provided “as is,” may change or be discontinued, and may have different limits or policies.
12. Disclaimers
EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that screenshots will be identical across sites or immune to third-party changes.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBcap AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT PAID BY YOU TO WEBcap IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
14. Indemnification
You will indemnify and hold Webcap harmless from any claim, loss, or damage arising from your use of the Service, your content, or your breach of these Terms or applicable law.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction where Webcap Inc. is formed, excluding conflict-of-law rules. Disputes will be resolved in the courts located in that jurisdiction, unless a separate written agreement specifies arbitration or another forum.
16. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted on this page or communicated via the dashboard or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
